1. Definition of a Temporary Residence Card

A Temporary Residence Card (TRC) is an official document that allows foreigners to legally reside and work in Vietnam. It serves as a substitute for short-term visas and permits multiple entries within its validity period.

The TRC not only helps save time and costs compared to multiple visa applications, but also facilitates a more stable and convenient long-term stay and employment in Vietnam.

According to Clause 13, Article 3 of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam (2014):

“A Temporary Residence Card is a document issued by the Immigration Department or by a competent authority of the Ministry of Foreign Affairs to a foreigner who is permitted to reside in Vietnam for a definite period of time, and which serves as a substitute for a visa.”

 

2. Eligible Cases and Duration of Temporary Residence Cards

Under Law No. 51/2019/QH14 amending and supplementing certain provisions of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam, the following categories of foreigners are eligible for a Temporary Residence Card:

Notes on Validity

·         The above durations represent maximum validity periods. The actual duration of a TRC depends on factors such as the visa type, supporting documents, and passport validity. The TRC is issued with an expiry date at least 30 days shorter than the passport’s remaining validity.

·         Foreigners with expired TRCs may apply for renewal or reissuance.

 

3. Conditions for Issuing a Temporary Residence Card

To qualify for a TRC in Vietnam, eligible foreigners must meet the following conditions:

·         Possess a passport valid for at least 13 months. Since the TRC must be valid for at least 30 days less than the passport’s expiry date, a 13-month passport allows a TRC of up to 12 months. Therefore, foreigners seeking longer validity should renew their passport before applying.

·         Have duly completed temporary residence registration at the local police authority (Commune/Ward Police Office).

Foreigners Not Eligible for TRC Issuance:

·         Those under criminal investigation or defendants in ongoing civil, economic, or labor disputes;

·         Those subject to the execution of criminal judgments;

·         Those required to execute civil or economic judgments;

·         Those obligated to fulfill administrative penalties, tax duties, or other financial obligations in Vietnam.

Applications for TRCs are processed by the Immigration Department, Ministry of Public Security, or by the Immigration Management Divisions of provincial/municipal police departments.
