Foreigners who possess a valid Work Permit or Work Permit Exemption Certificate with a duration of 12 months or more are eligible to be granted a Temporary Residence Card (TRC).
The validity of the TRC corresponds to the remaining validity of the Work Permit or Work Permit Exemption Certificate.
Applications for TRCs may be submitted directly in person or online via the National Public Service Portal.


1. Validity of Temporary Residence Cards for Foreigners Working in Vietnam

According to the current labor legislation, the maximum duration of a Work Permit for foreigners is 02 years.
Accordingly, the maximum validity period of a TRC issued to a foreign worker in Vietnam shall not exceed 02 years.

Note on Passports of Foreign Applicants:

  • If the applicant’s passport has less than two (02) years of remaining validity, the TRC will be issued in accordance with the passport’s remaining validity, but not less than one (01) year.

  • For Chinese citizens holding electronic (chip-based) passports (E-passports), TRC applications will be converted into a visa valid for a maximum of one (01) year.


2. Conditions for Applying for a Temporary Residence Card for Foreign Workers

  • The applicant’s passport must be valid for at least one (01) year.
    To apply for a two-year TRC, the passport must have a remaining validity of more than two (02) years.

  • The visa currently in use in Vietnam must be consistent with the purpose of entry, i.e. bearing symbols LĐ, LĐ1, LĐ2, DN, DN1, or DN2, issued under the sponsorship of the current employing enterprise.

  • In cases where a foreigner wishes to convert from another visa/TRC type to a work-based TRC, a valid Work Permit or Work Permit Exemption Certificate and other relevant supporting documents must be provided, in accordance with Clause 4, Article 7 of Law No. 51/2019/QH14 amending the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam.

  • The Work Permit (or Work Permit Exemption Certificate) must be valid for at least 12 months at the time of submission.


3. Application Dossier for Issuance of a Temporary Residence Card for Foreign Workers

a. Documents required for direct submission

  • Certificate of business operation of the employing organization (e.g. Business Registration Certificate, Investment License, Operation License of Representative Office or Branch, etc., depending on the enterprise type).

  • Certificate of seal registration or written notification of publication of enterprise seal specimen on the National Business Registration Portal.

  • Form NA16 – Registration of seal and signature specimen of the legal representative.

  • One (01) certified copy of the foreign employee’s Work Permit or Work Permit Exemption Certificate.

  • Forms NA6 and NA8 – Application forms for TRC issuance.

  • Letter of introduction authorizing a Vietnamese staff member to submit the application at the Immigration Authority.

  • Original passport, current visa/TRC (Note: the visa must match the purpose of work; if the applicant already holds a TRC, the existing card must also be presented).

  • Online temporary residence registration form or Certificate/Book of temporary residence registration confirmed by the local police of the ward/commune where the foreigner resides. (Note: the Immigration Authority may request this document in certain cases.)

  • Two (02) photos sized 2 cm × 3 cm.

Additional Notes:

  • Applicants converting from a tourist, visiting-relative, or investor visa/TRC to a work-based TRC must provide an explanatory letter stating the rationale and legal basis for conversion.

  • In cases of change of employer, the applicant must submit a resignation decision (or equivalent document) and an explanatory statement confirming the legitimacy of the job transfer.

  • Dependents (spouses or children under 18 years old) of foreign workers must submit notarized Vietnamese translations of documents proving family relationships such as Marriage Certificates, Birth Certificates, or Family Relationship Certificates.

  • For reissuance of a TRC due to loss, damage, or new passport, an explanatory report and the new passport must be provided.

b. Place of submission

Depending on the specific case, dossiers may be submitted to either:

  • The Immigration Department – Ministry of Public Security, or

  • The Immigration Division under the Provincial/City Police Department where the enterprise is located.

c. Processing time

According to current regulations, the processing time for TRC issuance is 05 working days from the date the Immigration Authority receives a complete and valid dossier.


4. Online Application for Temporary Residence Cards for Foreign Workers

a. Required documents

  • Business Registration Certificate / Investment Certificate / Operation License / Establishment Decision, depending on enterprise type.

  • Form NA16 – Registration of seal and signature specimen of the legal representative.

  • Forms NA6 and NA8 – Application for TRC (one original copy each).

  • Original passport / visa / existing TRC.

  • Two (02) photos sized 2 cm × 3 cm (one attached to Form NA8, one enclosed separately).

  • Online temporary residence registration form or temporary residence confirmation issued by the local police.

  • Letter of authorization / introduction from the sponsoring enterprise or organization.

  • One (01) certified copy of the Work Permit or Work Permit Exemption Certificate.

b. Online submission procedure

Step 1: Use the enterprise’s digital signature USB token to create an account on the National Public Service Portal.
Step 2: Log in to the registered account.
Step 3: Fill in the applicant’s details and upload all required documents (in PDF format).
Step 4: Review all information and attached documents carefully, then submit the application online.
Step 5: Save the application code for tracking the processing status.
Step 6: Bring the passport, visa/TRC (if any), and the submitted documents to the Immigration Department as instructed by the online system.
Step 7: Pay the applicable fee as guided by the National Public Service Portal upon acceptance of the dossier.
